Adkins v. Children’s Hospital (1923)

Written portion (approx. 3-4 pages):

To be submitted electronically (on Canvas) before class on the due date. These will include discussing the basic facts of the case, summaries of the concurring and dissenting opinions, and a discussion of any relevant legal doctrines. In the written portion of the assignment, you will also be expected to discuss in 1-2 paragraphs how the case relates to the course as a whole and the legal doctrine/topic we are discussing at that point in the course.

Three examples of how a case brief should look are provided in the Files section of this website. Each written brief should contain 5 sections:

Facts of the case
Issue (a basic, one or two-sentence summary of the question before the court)
Precedents/Relation to Course (here is where you should include your 1-2 paragraphs about how this relates to the course and what we are currently studying but this does not need to be part of the oral presentation).
Arguments (include both those for and against)
Decision (include a summary of the majority and concurring or dissenting opinions as relevant)

NB: Case briefs are often available online. However, I will know if you plagiarize these, since I am requiring an electronic copy of your assignment. You can use your textbook and anything you find online as a guide for what is important, but for your own sake, be sure to write these in your own words as any evidence of plagiarism will result in a 0 on this assignment.
