Alternative to Dispute Resolution (ADR)
COMMUNICATION ASSIGNMENT
Pick a fictional conflict from a movie, TV show, book, video game, or other form of media. The conflict must be interpersonal (i.e., between two people) and have escalated significantly (i.e., the conflict is starting to threaten the relationship between the characters). For example, you might choose Ross and Rachel’s breakup in Friends (https://www.youtube.com/watch?v=wWwgLKPTLT0). Your chosen conflict will become your case study.
Then, choose one of the Alternative to Dispute Resolution (ADR) techniques from your book. The five ADRs are: arbitration, adjudication, ombudsperson, conciliation, and mediation. Pick the ADR that you think would work best, if you were to try to resolve the dispute between these characters. Your job is to consult on the case and analyze how the conflict should be resolved using the ADR type.
Then, write up your case study in a 2-page double-spaced paper. In this paper:
• Briefly describe (i.e., one paragraph or less) the characters and the conflict between them
• Explain the steps for the ADR technique (i.e., walk the reader through the ADR technique using the case study as an example, considering the complexities, required information, and small details necessary to resolve the dispute in this particular situation)
• Discuss potential pitfalls of what could potentially go wrong during the dispute resolution (i.e., out of all other outcomes, how might each party ensure that they get the best outcome possible? What words of advice would you offer each party in the situation? What next steps should be taken?)
• Conclude with final takeaways based on this case study.
Note: The paper should be written using APA Style, however, you do not need to include a reference page for the textbook or course materials. If you include outside sources, you should include a reference in APA style. Use 1-inch margins, 12-point Times New Roman font, and double-space your paper, removing the extra space after paragraph. The page limit is strict. You should have at least two full pages.
