Align Technology is a critical innovator in dental equipment trading at $335.81 on Nasdaq, obviously a giant in the dental industry. 3Shape, on the other hand, is an up-and-coming company. A recent communication by 3Shape was published in Yahoo News on October 21, 2020, title “Align Technology Backs out of Patent Infringement Case Against 3Shape.” The newsletter seems to express a relief by 3Shape for Align Technology to back out of patent infringement in a DC court. Align filed 8 patents infringement against 3Shape. The communication express, ‘Aligns’ apparent strategy of using litigation to attack 3Shape of competing in the marketplace”. While this case is dropped, Align has filed a new Texas case, alleging seven additional Align US Patents. The new lawsuit alleges that 3Shapes intraoral hardware’s and software products infringe Algin’s patents.

The ethical issues found here is a big corporation using the laws in the book to hinder competition. Align Technology’s decision to back out of the DC 1950 case indicates intimidation or fear of a rival. Since the case was withdrawn, there is no way of knowing if a patent infringement has occurred. The new litigation is yet to be taken by the court. I stand for intellectual property rights; however, in some cases such as this, Align Technology is using its financial power to bully a small company, which I agree with 3Shape assessment. The possible end game of buying them out or destroying the company. The loser in all this is the consumer who misses out on the competition. It is worth mentioning that 3Shape also a patent infringement and antitrust litigation against Align Technology.

A common occurrence of copyright infringement occurs often in the world of social media. For example, a celebrity will post a photo to Instagram that does not belong to them. Usually, this is because the photo was not taken by the celebrity, but was taken by some other professional photographer. In order for this to be done legally, the photo in question must be properly licensed by the celebrity and whoever their production company happens to be. An example of this occurred earlier this year. In may, actress/singer Jennifer Lopez posted a photo that was allegedly owned by someone else. This photographer then sued her for 150,000 dollars. The article did not mention the actual outcome of this case.

As far as ethics go, I think the photographer probably deserves some form of reasonable compensation, provided that their claim to ownership is accurate. It isn’t really fair for someone of status to take advantage of someone who has provided a service to them. That being said, this may have simply been some sort of oversight on the part of the production company/whoever runs her Instagram account. Either way, the photographer should be paid for their photograph, as long as they actually legally own it.

Question: What are the differences between snapshots and backups? Briefly describe which situations are better suited for each.

Snapshots are copies of the servers or volumes from a certain point in time. Unlike a disaster recovery feature that can be activated on its server, snapshots are manually created at the users discretion. Snapshots are perfect for situations such as when you need to do some maintenance on a server or during upgrades and patching. A daily snapshot is typically taken from the disaster recover that runs during nightly updates, but if you wanted a save point before serious maintenance goes underway, this is where snapshots can really shine.

Backups are a little more intensive than snapshots since there are several different types of backups. A full backup is the most basic of backup types. The full backup is a complete copy of the chosen data and is the most extensive. This backup requires a large amount of storage and is very time consuming to complete. An incremental backup is much faster to complete since it only copies the data that has been changed since the last full backup. This backup is best suited if routine changes are made.
