The testimony of an eyewitness to a crime is usually important to both the prosecution and the defendant. If the testimony is credible, the jury is likely to give it greater weight. Yet, Elizabeth Loftus argues eyewitnesses may succumb to false memories, thus creating doubt. Answer these questions in your essay:
What are false memories and the implications of eyewitness false memories? Consider writing about the consequences to the defendant, victim, and the justice system.
What recommendation(s) would you suggest to identify when a false memory may be occurring with a witness? For example, should the jury receive instructions about false memories when determining the credibility of a witness?
